U is for UNDUE INFLUENCE. One of the ways that a will, trust or power of attorney in challenged in court is by claiming that the person signing the document did not do so of their own free will, act and deed, but rather was being forced by a third party or parties. Regrettably, this happens more frequently as the baby boomer generation transfers assets to their children and grandchildren, and unscrupulous people try to change an elderly relative’s mind or document. Elder Abuse is a rapidly growing phenomenon, and not likely to disappear soon.
